This comes after former Deputy President Rigathi Gachagua went to court to question the legality of how Kithure Kindiki was appointed to the office of the deputy president of the Republic of Kenya after his removal from office by way of impeachment.
Gachagua had argued that there was no public participation in the process of nominating H.E Prof. Kithure Kindiki as the Deputy President of the Republic of Kenya to replace him Rigathi Gachagua.
The court dismissed the claims holding that there was no requirement for conducting public participation in the process of nominating Kithure Kindiki to the office of the deputy president.
On his reinstatement to office, the High court held that the matter was long overdue since there was already a deputy president in that office who is none other than H. E Prof. Kithure Kindiki
